Texas is an "at-will" employment state. This phrase discourages many workers from seeking legal help. "My boss said he can fire me for any reason he wants," they say. That is only half true.
The Exceptions to "At-Will"
Your employer can fire you for wearing a blue shirt (dumb, but legal). They CANNOT fire you for:
- Discrimination: Your race, color, religion, sex, national origin, age (40+), or disability.
- Retaliation: Because you filed a worker's comp claim, reported sexual harassment, or blew the whistle on illegal activities (Sabine Pilot doctrine).
- Refusal to Commit a Crime: If your boss ordered you to break the law and you refused.
Document Everything
Employers rarely say, "I'm firing you safe because you're pregnant." They will claim it was "performance." Your best defense is a paper trail. Save emails, text messages, and performance reviews. If you suspect an illegal motive, contact us immediately.
