Texas Standard Possession Order (SPO) Explained

Upon divorce or separation, Texas law presumes a "Standard Possession Order" (SPO) is best for children over age 3. But reading the decree can feel like deciphering code.

The Basics: 1st, 3rd, and 5th Weekends

The non-primary parent typically gets possession on the 1st, 3rd, and 5th Friday of a month. Note: Not every month has a 5th weekend, but about 4 months a year do.

The "Expanded" Option

Texas law now presumes parents should get "Expanded" SPO if they want it. This changes the pickup time from 6:00 PM Friday to when school dismisses, and return time from 6:00 PM Sunday to when school resumes Monday morning. This gives the non-primary parent significantly more time (overnights).

Holidays Rule All

Holiday schedules (Christmas, Thanksgiving, Spring Break) override the weekend schedule. Parents alternate years (e.g., Mom gets Christmas even years, Dad gets odd years). Knowing this schedule is crucial for planning vacations.
