Can I Be Fired for Posting on Social Media?

We see it all the time: someone gets fired for a controversial tweet or Facebook post, and they scream, "Freedom of Speech!"

The Harsh Reality

The First Amendment says "Congress shall make no law..." It restricts the government. It does not restrict private companies. If you work for Walmart, Amazon, or a local shop, they can generally fire you for speech they dislike (unless it's protected concerted activity under the NLRB).

Public Employees are Different

If you work for the government (teacher, police officer, city clerk), you do have First Amendment protections. The government cannot fire you for speaking as a citizen on a matter of "public concern," unless your speech disrupts the workplace efficiency (the Pickering balance).
